Terms of Service
Last updated: May 2026
These terms govern your use of toughwebco.ca and any services you receive from TOUGH Web Co.. By using the site or buying our services, you agree to these terms.
[TODO] Before going public, have these terms reviewed by a lawyer or a service like LawDepot. Replace any placeholder with real business details.
Services
We provide custom web design, web development, and digital marketing services to businesses. Every project starts with a written quote that outlines scope, deliverables, timeline, and price. We don’t start work or invoice until both sides sign off.
Payment
- Lump-sum: 50% deposit to start, 50% on delivery, unless agreed otherwise.
- Monthly packages: billed in advance via a recurring invoice. Cancel anytime with 30 days notice.
- Hybrid or custom plans: as agreed in writing.
Invoices are due 14 days from issue. Late payments may pause active work and accrue interest at 1.5% per month after 30 days.
Refund / satisfaction guarantee
If, within 7 calendar days of project delivery, the work is materially not what was agreed in the written quote, we’ll refund your deposit and you keep nothing of the work product. After that 7-day window, refunds are at our discretion.
Ownership
On final payment, you own the website code, content, and domain outright. We retain the right to display screenshots and a description of the project in our portfolio unless you ask us not to in writing.
Hosting and maintenance
Sites are deployed on Vercel by default. If you pay for the monthly hosting/updates plan, we keep your site updated, address minor content changes, and respond to issues within one business day. Service outages caused by Vercel, your domain registrar, or other third-party providers are beyond our control.
Your responsibilities
- Provide content (text, photos) by the dates we agree on.
- Respond to revision requests within a reasonable time.
- Make sure any content you provide is yours to use, or properly licensed.
- Keep your account credentials secure if you have admin access.
Liability
Our liability to you for any claim related to our services is limited to the amount you paid us in the 12 months before the claim. We don’t guarantee specific business outcomes (rankings, sales, revenue) since those depend on many factors outside the website.
Termination
Either side can end an ongoing engagement with 30 days written notice. On termination, we hand over all work in progress and you pay for work completed up to that date.
Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of Alberta.
